Effective date: June 26, 2026
FluenceXR, LLC (“Company,” “we,” “us,” or “our”) operates the FluenceXRplatform (“Service”). This Privacy Policy explains what information we collect, how we use and share it, and your choices. By using the Service, you agree to this policy. If you do not agree, please do not use the Service.
1. Information We Collect
1.1 Information You Provide
- Account information: name, email address, and password when you register.
- Profile information: display name and profile photo you choose to upload.
- Video content: competition footage and related metadata you submit for analysis.
- Communications: messages you send us through support channels.
- Marketing preferences: your choice to receive or opt out of promotional emails at registration or in account settings.
1.2 Information Collected Automatically
- Usage data: pages visited, features used, submission and playback activity, timestamps, and referring URLs.
- Device and browser data: IP address, browser type and version, operating system, and screen resolution.
- Cookies and similar technologies: we use session cookies to authenticate you and maintain your session. We do not use third-party advertising cookies.
1.3 Payment Information
Payment card details are collected and processed directly by Stripe, Inc. We receive only limited transaction metadata (amount, currency, payment status, and a non-reversible token). We never store your full card number, CVV, or expiration date.
1.4 Pro Account Information
If you apply as a Pro, we collect additional information including professional credentials, a bio, webcam video recordings made during breakdown sessions, and Stripe Connect onboarding information required to facilitate payouts.
2. How We Use Your Information
We use the information we collect to:
- Create and manage your account
- Deliver and improve the Service, including routing submissions to Pros and making breakdowns available for playback
- Process payments and manage billing
- Send transactional emails (account confirmation, breakdown delivery notifications, dispute updates, receipts)
- Send promotional emails if you have opted in, and suppress them if you have opted out
- Respond to support requests and resolve disputes
- Detect, investigate, and prevent fraud, abuse, and violations of our Terms of Service
- Comply with legal obligations
- Analyze aggregate, de-identified usage patterns to improve the platform
We do not sell your personal information to third parties. We do not use your video content to train machine learning or AI models without your explicit consent.
3. How We Share Your Information
3.1 With Pros
When you submit footage for review, the assigned Pro will have access to your submitted video and the name on your account profile. Pros are contractually obligated to keep your content confidential and to use it only for the purpose of delivering your breakdown.
3.2 Service Providers
We share information with third-party vendors who help us operate the Service. These vendors are contractually restricted from using your data for any purpose other than providing services to us:
- Supabase: database hosting and authentication infrastructure
- Stripe: payment processing and Pro payout disbursement
- Cloudflare: video storage, processing, and delivery
- Vercel: application hosting and anonymous, cookieless performance metrics (page load speed) that carry no personal identifiers
3.3 Legal Requirements
We may disclose your information if required by law, subpoena, court order, or government authority, or if we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others.
3.4 Business Transfers
If FluenceXR is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you via email or a prominent notice on the Service before your information becomes subject to a different privacy policy.
4. Data Retention
We retain your account information and User Content for as long as your account is active or as needed to provide the Service. If you close your account, we will delete or anonymize your personal information within 90 days, except where we are required to retain it for legal, tax, or fraud-prevention purposes (e.g., payment records, which we retain for 7 years per applicable financial regulations).
Delivered breakdowns — including Pro webcam recordings associated with your submission — are retained as part of your account history and will be deleted when your account is deleted.
5. Security
We implement industry-standard technical and organizational measures to protect your information, including encrypted data storage, TLS in transit, role-based access controls, and signed URLs for all media access. No method of transmission over the internet is 100% secure, and we cannot guarantee absolute security. If you believe your account has been compromised, contact us immediately at support@fluencexr.com.
6. Children's Privacy
The Service is not directed to children under 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected information from a child under 13 without verifiable parental consent, we will delete that information promptly. If you believe a child under 13 has provided us with personal information, please contact us.
Users between 13 and 17 must have a parent or guardian who has consented to these Terms and this Privacy Policy on their behalf. We encourage parents to monitor their children’s use of our Service.
7. Your Rights and Choices
7.1 Account Information
You may access, update, or correct your account information at any time through your account settings. You may request deletion of your account by contacting us.
7.2 Marketing Emails
You may opt in or out of promotional emails at any time through your account notification settings or by clicking “unsubscribe” in any marketing email. Opting out does not affect transactional emails related to your account or submissions.
7.3 California Residents (CCPA)
If you are a California resident, you have the right to: (a) know what personal information we collect and how it is used; (b) request deletion of your personal information; (c) opt out of the sale of your personal information (we do not sell personal information); and (d) not be discriminated against for exercising your rights.
To exercise these rights, contact us at privacy@fluencexr.com. We will respond within 45 days.
7.4 EEA / UK Residents (GDPR)
If you are located in the European Economic Area or United Kingdom, you have rights under the General Data Protection Regulation (GDPR), including the right to access, rectify, erase, or port your personal data, and the right to object to or restrict processing. Our legal basis for processing your data is performance of the contract with you (account and Service operation), legitimate interests (security and fraud prevention), your consent (marketing emails), and legal obligation (financial records).
To exercise GDPR rights, contact us at privacy@fluencexr.com. You also have the right to lodge a complaint with your local data protection authority.
8. Cookies
We use strictly necessary cookies to authenticate sessions and keep you logged in. We do not use advertising or tracking cookies from third parties. Our hosting provider collects anonymous, cookieless performance metrics (such as page load speed) that carry no personal identifiers. You may configure your browser to refuse cookies, but doing so will prevent you from logging in and using the Service.
9. Third-Party Links
The Service may contain links to third-party websites. This Privacy Policy does not apply to those sites, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party sites you visit.
10. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the effective date above and, for material changes, notify you via email or a prominent notice on the Service. Your continued use of the Service after the updated policy takes effect constitutes acceptance of the revised policy.
